If you have any sort of income and astess, you may not qualify for bankruptcy and may spend money needlessly pursuing this option. This statement is false. Having income and astess does not disqualify you for bankruptcy. Those with income above the median for their state may not qualify for a Chapter 7, but they can still file a Chapter 13 which is a 3 to 5 year plan to pay as much debt as you can afford with most remaining unsecured debt being discharged upon completion of the plan. Having astess doesn't disqualify you from any bankruptcy. If you have non exempt astess and file a Chap 7, those astess may be sold to pay your creditors. If you file a Chap 13, you can keep the astess as long as you pay at least the non-exempt value to your unsecured creditors during your 3 to 5 year plan. If you can't show enough income to pay that much, you may need to give up some non exempt astess to get your Chapter 13 plan confirmed.
